All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of South Africa.

Order and Purchase Terms

Regarding Order Requests

At Afrimart, we strive to provide accurate shipping cost estimates and delivery times. However, these are subject to change based on your location and the specifics of your order. Once you submit your order request, our team will carefully review all the details, including the final price and product availability. We'll then confirm the order with you.

You have the flexibility to cancel your order request at any point before it's confirmed. After confirmation, cancellations may not be possible, and our standard return policy will apply.

Quotation and Orders

Validity

This quotation is valid for 14 days from the date of issue, unless otherwise stated or withdrawn earlier by Afrimart Online.

Acceptance & Contract Formation

This document constitutes an offer. A binding contract ("the Agreement") is formed only upon Afrimart Online's receipt of the required deposit and the subsequent issuance of an Order Invoice to the Buyer. The Agreement comprises this Quotation and the Order Invoice, to the exclusion of all other terms.

Price, Deposit & Payment

• The total price is as specified in the Quotation
• A non-refundable deposit of the total price is required to initiate the order or unless agreed otherwise
• The remaining balance must be paid in full before shipment is dispatched from our warehouse
• Late payments shall bear interest at a rate of 2% per month, compounded monthly

Delivery, Risk & Inspection

• The estimated delivery lead time to the Afrimart Online Midrand Warehouse is 35–60 days from the receipt of the deposit. Timelines may be affected by customs, logistics, or shipping factors beyond our control.
• Delivery Terms: Unless otherwise stated, delivery is to the Afrimart Online Midrand Warehouse. The Buyer is not responsible for all shipping, insurance, customs clearance, duties, and taxes for the international leg of shipping unless explicitly included in the Quotation
• Local Delivery: Local delivery from the Afrimart Online Midrand Warehouse to the Buyer's final address is not included in this Quotation and will be quoted separately. The Buyer is responsible for paying this separate charge to have the goods delivered to their door
• Storage: The Buyer must collect the goods from our Midrand Warehouse or arrange and pay for final delivery within 7 calendar days of being notified of their arrival. If the Buyer fails to do so, a storage fee will be charged until collection or final delivery is arranged
• Risk: Risk of loss or damage to the products shall pass to the Buyer upon delivery to the Afrimart Online Midrand Warehouse
• Inspection: The Buyer has 7 calendar days from the date the goods are made available for collection at our Midrand Warehouse (or from the date of final delivery to the Buyer's address, if applicable) to inspect the goods and report any visible damage or shortage in writing. Failure to report within this period will be deemed as acceptance of the goods

Title & Ownership

Title to the products remains with Afrimart Online until full payment of the total price, including any applicable interest, storage, or other charges, has been received.

Customer Responsibilities & Warranty

Limitation of Liability

Afrimart Online's total liability arising out of or in connection with this Agreement, whether in contract, tort (including negligence), or otherwise, shall not exceed the total price paid by the Buyer under this Agreement.

In no event shall Afrimart Online be liable for any indirect, consequential, or special damages, including loss of profits, data, or business opportunities.

Force Majeure

Afrimart Online shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, war, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.

Cancellation & Termination

• If the Buyer cancels the order for any reason, the deposit is non-refundable
• Afrimart Online may terminate the Agreement if the Buyer fails to pay the balance when due or breaches any material term of this Agreement

Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of South Africa.

Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of South Africa.

Data Protection

Afrimart Online will process the Buyer's personal data in accordance with applicable data protection laws, including the Protection of Personal Information Act (POPIA).

Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, representations, and discussions.

After Sales Support

Installation

For your convenience, we provide full installation instructions and specifications for your plumber and electrician upon request.

If you choose to have Afrimart Online (Pty) Ltd handle the delivery and commissioning of your equipment (at an additional cost), these charges will apply. Please note that any costs incurred due to restricted access, such as narrow doorways or other obstacles during delivery, will also be the customer's responsibility.

Additional Costs

Should there be any unforeseen delays caused by the client or additional mileage/labor required on the pre-arranged delivery and commissioning date, these extra costs will be billed directly to you by Afrimart Online (Pty) Ltd.

Warranties do not cover parts damaged due to negligence, misuse, or operator error.

Warranty

To ensure the longevity of your equipment, please consult your salesperson for recommended service and maintenance procedures. It is essential to follow these guidelines, as failure to do so may affect the validity of your warranty.

Limitation of Liability

Delivery times are approximate and not guaranteed. While we do our best to meet agreed timelines, delays may occur due to unforeseen circumstances. Afrimart Online (Pty) Ltd will not be held liable for any financial loss from the client arising from delivery delays unless caused by a willful breach.

Product Specifications

Please note that our quotes are based on the specifications provided by the customer, whether written or verbal. Dimensions used for quoting and manufacturing adhere to normal tolerances and variations.

We reserve the right to make changes to product specifications without prior notice, as part of our commitment to continuous improvement. While we strive to ensure accuracy, Afrimart Online (Pty) Ltd cannot be held responsible for any discrepancies in product specifications or dimensions.
